The California Consumer Privacy Act (CCPA) went into effect on January 1, 2020. This new data protection law will affect businesses around the world. The law places high demands on companies. In particular, companies will be required to fully disclose how they handle consumers` personal data. 39. Feeding. When formulating national food policies and plans, Governments should take into account the food security needs of all consumers and support and, to the extent possible, adopt the standards of the Food and Agriculture Organization of the United Nations and the Codex Alimentarius of the World Health Organization or, failing that, other generally accepted international food standards. Governments should maintain, develop or improve food safety policies, including, inter alia, safety criteria, food standards and nutritional needs, as well as effective monitoring, inspection and evaluation mechanisms. The origins of the guidelines date back to the late 1970s, when the Economic and Social Council recognized that consumer protection had a significant impact on economic and social development. In 1977 the Council asked the Secretary-General to draw up a study of national institutions and legislation in the field of consumer protection. In 1979, the Council asked the government to submit a comprehensive report containing proposals for consumer protection measures. In 1981, the Council, recognizing the need for an international policy framework for further efforts to protect consumers, invited the Secretary-General to continue consultations with a view to developing a set of general guidelines for consumer protection, taking particular account of the needs of developing countries. 20.
Advertising labelling and sales practices should be guided by the principle of fair treatment of consumers and comply with legal requirements. This requires providing the necessary information to enable consumers to make informed and independent choices, as well as measures to ensure the accuracy of the information provided. 30. Consumers should be provided with information on available remedies and other dispute resolution mechanisms. The CCPA includes a new set of consumer rights. Your privacy policy should inform your consumers of their rights. 35. Businesses should, where appropriate, implement or participate in evidence-based and relevant consumer education and information programmes. 16. The government should adopt or maintain guidelines that specify the manufacturer`s responsibility and ensure that the goods meet reasonable requirements for durability, utility and reliability and are fit for their intended use, and that the seller should ensure that these requirements are met.
Similar guidelines should apply to the provision of services. 12 million Governments should, in their own national context, promote the development and implementation of marketing codes and other business practices by enterprises, in cooperation with consumer organizations, in order to ensure adequate consumer protection. Voluntary agreements may also be concluded jointly by businesses, consumer organisations and other interested parties. These codes should be adequately publicized. 21. The government should encourage all stakeholders to participate in the free flow of accurate information on all aspects of consumer products. 42. In addition to the priority areas mentioned above, Governments should take appropriate action in other areas, such as pesticides and chemicals, where appropriate with regard to their use, production and storage, taking into account this relevant health and environmental information.
10. Appropriate strategies should be put in place to ensure that goods manufactured by manufacturers are safe for their intended or normally foreseeable use. Those responsible for placing goods on the market, in particular suppliers, exporters, importers, retailers and similar persons (hereinafter referred to as `distributors`), should ensure that, while in their custody, such goods are not processed by improper handling or storage and that they do not become dangerous in the course of possession due to improper handling or storage. Consumers should be informed of the correct use of goods and of the risks associated with the intended or reasonably foreseeable use. Important safety information should, as far as possible, be communicated to consumers by means of internationally understandable symbols. Accordingly, the Secretary-General consulted Governments and international organizations and submitted draft guidelines for consumer protection to the Economic and Social Council in 1983. Over the next two years, there were extensive discussions and negotiations among governments on the scope and content of the guidelines, leading to their adoption in 1985. The CCPA is not (only) for California-based companies. It is intended for any company that processes consumer personal information in California. Like another major California privacy law, the California Online Privacy Protection Act (CalOPPA), the CCPA applies to businesses around the world. 36. Taking into account the need to reach rural and illiterate consumers, Governments should, where appropriate, develop or promote the development of consumer information programmes in the media.

The government should intensify its efforts to prevent practices that harm consumers` economic interests by ensuring that manufacturers, traders and others involved in the supply of goods and services comply with applicable laws and mandatory standards. Consumer organisations should be encouraged to monitor adverse practices such as food adulteration, false or misleading claims in marketing and fraud in services. If the Company sells personal data, the consumer also has the right to request access to the following information: 23. Governments should regularly review legislation on weights and measures and assess the adequacy of enforcement mechanisms. Here`s how the CCPA`s privacy policies align with two other major data protection laws: GDPR (EU) and CalOPPA (California). (11) Appropriate strategies should be put in place to ensure that manufacturers or distributors who become aware of unforeseen risks after devices have been placed on the market inform the competent authorities and, where appropriate, the public without delay. The government should also consider ways to ensure that consumers are properly informed about these dangers. 29. The government should encourage all businesses to resolve consumer disputes fairly, expeditiously and informally and to establish voluntary mechanisms, including advisory services and informal complaint resolution procedures, that can help consumers.

It is not enough to inform consumers of their rights. They need to put in place a system to help consumers exercise their rights. This often has to include a toll-free number and a website. (8) When applying consumer protection procedures or rules, care should be taken to ensure that they do not become barriers to international trade and are compatible with international trade obligations.
